Daniel Sanchez is facing federal charges for what free speech advocates say is a clear attack on the First Amendment.

Federal prosecutors have filed a new indictment in response to a July 4 noise demonstration outside the Prairieland ICE detention facility in Alvarado, Texas, during which a police officer was shot.

There are numerous problems with the indictment, but perhaps the most glaring is its inclusion of charges against a Dallas artist who wasn’t even at the protest. Daniel “Des” Sanchez is accused of transporting a box that contained “Antifa materials” after the incident, supposedly to conceal evidence against his wife, Maricela Rueda, who was there.

But the boxed materials aren’t Molotov cocktails, pipe bombs, or whatever MAGA officials claim “Antifa” uses to wage its imaginary war on America. As prosecutors laid out in the July criminal complaint that led to the indictment, they were zines and pamphlets. Some contain controversial ideas — one was titled “Insurrectionary Anarchy” — but they’re fully constitutionally protected free speech. The case demonstrates the administration’s intensifying efforts to criminalize left-wing activists after Donald Trump announced in September that he was designating “Antifa” as a “major terrorist organization” — a legal designation that doesn’t exist for domestic groups — following the killing of Charlie Kirk.

Sanchez was first indicted in October on charges of “corruptly concealing a document or record” as a standalone case, but the new indictment merges his charges with those against the other defendants, likely in hopes of burying the First Amendment problems with the case against him under prosecutors’ claims about the alleged shooting.

It’s an escalation of a familiar tactic. In 2023, Georgia prosecutors listed “zine” distribution as part of the conspiracy charges against 61 Stop Cop City protesters in a sprawling RICO indictment that didn’t bother to explain how each individual defendant was involved in any actual crime. I wrote back then about my concern that this wasn’t just sloppy overreach, but also a blueprint for censorship. Those fears have now been validated by Sanchez’s prosecution solely for possessing similar literature.

For starters, “violence” is an incredibly vague category. It inevitably has an ethical or even moralistic connotation, and yet more than any other institution mass media defines what “violence” means. That’s not the case with, say, “solidarity” or “sabotage,” which for some odd reason the media don’t talk about as much. (Eventually I’ll have another article out on word slippage and in which cases it makes sense to resist.)

Here’s the rebuttal. Self-defense works to protect what you already have. Those who are lucky enough to have food, a house, bodily autonomy, healthcare, a good relationship with the land—they can use self-defense to protect what they have against any person or institution trying to take it away, and this is legitimate.

But what happens when you wake up in a world that has already been entirely invaded by colonial powers, by capitalism and the State? What happens when there’s already a gigantic economic machinery in place, slowly poisoning and killing everyone? What happens when you’ve been forced into dependence on that Machine? In that situation, no liberation, no survival, is possible without the Attack. And we’ve learned, generation after generation, that a struggle cannot be effective, it cannot thrive or succeed, if it limits itself to defense.

My name is Ehab, a father of four children from Gaza. Before October 7th, we lived in a warm home filled with love, laughter, and hope. My children were among the brightest in their schools, and life—though simple—was beautiful.

But everything changed in a single moment. We lost our home, our work, our loved ones, and everything we once had. My sister and her children were killed, and my wife—who was pregnant at the time—was forced to give birth in Egypt with a very dangerous condition as her blood count had dropped to 7.

For nearly a year, my wife and children endured the war in Gaza before they managed to leave. I couldn’t go with them because I didn’t have enough money. I have now been separated from my children for over a year and a half. My youngest daughter, Talia, was born far away from me, and I have never even held her in my arms.

Today, I live alone in a torn tent—suffering from the burning heat of summer and the freezing cold of winter. Many nights I go to sleep hungry, with nothing to eat. My children, on the other hand, live in an old crumbling apartment that barely lets sunlight in. They cry themselves to sleep, longing for their father. We struggle every day to afford rent, diapers, and milk.

And now, the Israeli army demands that we leave northern Gaza and move to the south. But where can we go? The costs are unbearably high, and we have no safe place left. The painful question that haunts us every day is: Where do we go?

The pages of the New York Times drip with the rhetoric of genocide accomplices and apologists. Times editors, executives, and journalists have proven themselves to be the bedfellows of the Zionist regime, benefiting from and profiting off of the atrocities their lies enable. To run media cover for U.S. imperial interests is to support and legitimize genocide, and to serve as a cog in the well-oiled war machine. To publish known lies is to abet the laundry list of Zionist war crimes. Those who commit such malpractice are not journalists; they are genocide propagandists, and their hands are stained red by the crimes that they incite, defend, and obscure.
