Because the cop would have had a heart attack and then he'd be charged with murder?
To be fair, biking uses different muscles from running so if the cop is not a cyclist (and doesn't use stairs for training since stairs are a very similar set of muscles to cycling) the suspect just has to stay out of reach for about half a mile, which for anyone who cycles regularly should be pretty easy to do
